Road Closure - Police Investigation
On Wednesday September 29, 2010, between the hours of 8:00 am and 1:00 pm, there will be some lane closures in the 400 block of North Harvey Mitchell Parkway (FM 2818). The outside north and southbound lanes on North Harvey Mitchell Parkway, between Labrisa Dr. and West Villa Maria Rd., will be closed. The inside lanes in both directions will be open. These lanes will be shut down in order for the Traffic Safety Unit to investigate today’s auto-pedestrian fatality accident that occurred at 7:41 am.
Motorists are asked to use caution when traveling through the area. Officers will be working on both sides of the road and crossing the road. Please consider using an alternate route to avoid the area. Those who have to travel through the area should expect delays and are asked to please be patient.
The Bryan Police Department would like to remind all motorists that Texas enacted the Move Over Law in September of 2003. The law requires drivers nearing stopped emergency vehicles, with lights activated, to either slow down or change lanes.
The “Move Over Law” requires drivers to take the following actions.
• Vacate the lane closest to the emergency vehicle if the highway has two or more lanes traveling the direction of the emergency vehicle.
• Slow to a speed not more than 20 mph less than the posted speed limit when the posted speed limit is 25 mph or more.
• Slow to a speed not more than 5 mph when the posted speed limit is less than 25 mph.
Emergency vehicles include police, emergency medical service and fire vehicles.
A violation is punishable by a maximum fine of $200. If the violation results in property damage, the maximum fine increases to $500. If the violation results in bodily injury, the offense is enhanced to a Class B misdemeanor.
